By applying, you agree to abide by these Application Terms and the decisions of Visit North Carolina (“Visit NC”) and its designees, which shall be final and binding in all respects relating to this search (“Search”).
Visit NC is conducting a search for a Dog Travel Agent.
Individuals, 18 or older, who are legal residents of North Carolina who are the legal owners of a lawfully registered, licensed and fully vaccinated dog are eligible to apply. Individuals must have traveled within North Carolina with such dog previously and be able to provide proof of such trip in a form acceptable to Visit NC. Neither individual nor dog can be acting as a spokesperson or influencer for any pet- or travel-related companies or brands at time of application; if selected, neither person nor dog may serve in spokesperson or influencer role for other travel-related companies or brands through June 30, 2020. Individuals and their dogs (if applicable) must be willing to submit to a background check if requested by Sponsor.
Through 11:59 p.m. Eastern Time (“ET”) on Sept. 15, 2019, record a 60-second video demonstrating your and your dog’s familiarity with dog-friendly North Carolina activities, attractions, places to stay and places to eat/drink, then (i) post it publicly to your Instagram feed using #choosemydoggo and tag @visitnc and (ii) visit dogtravelagent.com and follow the directions to complete and submit the application form (“Application”). Both steps of Application must be completed by 11:59 p.m. ET on Sept. 15, 2019 for Application to be eligible.
Application must be (i) in English and (ii) no more than 60 seconds in length. Limit one (1) Application per person. Any Application received from any person after the first Application will be void. Visit NC makes no guarantee that any individuals who submit an Application will be selected. Application should include no other individuals. Applications that subvert the application process will be void. All Applications become the property of Visit NC.
If you do not have an Instagram account, establishing an account is free. All Instagram terms apply. If your account is not set to “public,” your Application will not be eligible. If your dog is not selected as the Dog Travel Agent, you can return your account to “private” any time after the Search has ended and the Dog Talent Agent has been announced.
Content Restrictions: Application shall not contain, and you hereby represent and warrant that it does not contain, any content that directly or by implication:
Visit NC reserves the right to allow for minor fluctuations between the Application length limitation stated herein and the actual length of the Application submitted, as well as other minor deviations, based on clear intent to comply with these Terms, as determined by Visit NC in its sole discretion.
By submitting an Application, you agree and hereby grant to Visit NC and its designees, successors, licensees and assigns an unlimited, perpetual, irrevocable, assignable, royalty-free, fully paid-up license to reproduce, distribute, create derivative works of, edit, alter, post, combine with other materials, exploit and otherwise use the Application, and all elements embodied therein, together with the name, voice, performance, biographical information and/or other image of you and your dog (including, but not limited to, profile photo), in whole or in part, in any manner and in any and all media now known or hereafter devised (including, without limitation, on Visit NC’s websites and social media pages and/or accounts) throughout the universe for any purpose whatsoever, without compensation or notification to, or permission from, you or any third party. You agree that Released Parties (as defined below) are not responsible for any unauthorized use of Applications by third parties. Released Parties do not guarantee use of any Application and are not obligated to make use of any of the rights granted herein.
The owner of the potential Dog Travel Agent (“Owner”), if any, will be notified via the email or phone number provided on his/her Application and will be required to sign a Talent Agreement, which must be returned within the time period specified in the notification. Return of a notification as undeliverable, failure to sign and return and/or provide all requested documentation within the specified time period, the inability of Visit NC to contact the Owner within a reasonable time period, or noncompliance with these Terms by the Owner will result in disqualification.
Sponsor also reserves the right to conduct a background check of any criminal or civil records of one or more Owners and their dogs it is considering and Sponsor may disqualify potential Dog Travel Agents based on the results of the background check. To the extent necessary and as permitted by law, Owners shall authorize such a background check. Request by Sponsor for authorization of a background check does not guarantee that such Owner’s dog will be chosen as the Dog Travel Agent, regardless of results of the background check.
Exact obligations and services will be set forth in the Talent Agreement; however, owner and Dog Travel will be required to travel to destination in North Carolina (to be determined by Visit NC) by no later than Nov. 22, 2019 (dates to be mutually agreed upon between Owner and Visit NC). Travel and hotel accommodations and a stipend (to be determined by Visit NC) will be provided. Visit NC will determine travel itinerary in its sole discretion. In addition, Owner and Dog Travel Agent will be required to complete up to three (3) trips to destinations in North Carolina (to be determined by or mutually agreed upon with Visit NC) by no later than June 30, 2020. If requested, Owner and Dog Travel Agent must also agree to participate in various media events or interviews as required by Visit NC. All expenses and incidental travel costs associated with completing the services required not expressly stated in the Talent Agreement as being provided, including but not limited to, additional ground transportation, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes (including, without limitation, income and withholding taxes) or other expenses are the responsibility solely of Owner. Travel restrictions, conditions and limitations may apply. If, in the judgment of Visit NC, air travel is not required due to Owner’s proximity to a particular destination, ground transportation may be substituted for round trip air travel at Visit NC’s sole discretion. Visit NC reserves the right to change the dates of any trip.
Owner agrees to document the trips in North Carolina with a GoPro camera provided by Visit NC (“NC GoPro Footage”), as well as take photos during the trips and create at least 8 posts for YouTube, Instagram, Facebook, Twitter and Pinterest between Sept. 30, 2019 – June 30, 2020, and at least 3 long-form posts (~500 words) for Owner’s blog, VisitNC.com or both before June 30, 2020 (collectively, “Winner Materials”). NC GoPro Footage must be the original work of the Owner, must not be obscene or inappropriate and must be in keeping with Visit NC’s image. In addition, NC GoPro Footage must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. Visit NC will review and approve any Winner Materials prior to posting.
In addition, the North Carolina trips may be filmed, photographed or otherwise recorded by Visit NC (“Visit NC Footage”) and all right, title and interest in Visit NC Footage and the Winner Materials will be owned by Visit NC. Owner understands that Visit NC and its designees, successors, licensees and assigns may reproduce, distribute, display, perform, create derivative works based upon, or otherwise exploit the Winner Materials and Visit NC Footage and all elements embodied therein, in whole or in part, and together with the name, city and state of residence, voice, image, performance, photo, and/or other likeness of Owner and/or Dog Travel Agent embodied therein, in any manner, in any and all media, now known or hereafter devised, throughout the world in perpetuity, for advertising, promotional, commercial and other purposes, without further compensation, notification or permission. Visit NC has no obligation to make use of the rights granted herein. Owner understands Visit NC may decide to only use part or portions of the Winner Materials, which it will have the right to do in its sole discretion. Owner will have no approval over any materials created, in whole or in part, using the Winner Materials or the Visit NC Footage.
Search is void where prohibited by law. All applicable federal, state and local laws apply. By applying, to the extent permitted by law, you agree to release, discharge, hold harmless and indemnify Visit NC, Instagram, Inc., and their respective parents, affiliates, subsidiaries, alcohol manufacturers, distributors, wholesalers and retailers, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind (including, without limitation, arising from claims based upon copyright infringement, trademark infringement, invasion of privacy, defamation, or right of publicity) to persons, including death, or property resulting, in whole or in part, directly or indirectly, from your participation in the Search and/or the use of any Application by Visit NC or any other Released Party and/or your participation as the Owner, if selected (including any travel or activity related thereto).
To the extent permitted by law, Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered or garbled Applications, or posts or emails; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Search, including, without limitation, errors or difficulties which may occur in connection with the administration of the Search, the Application of Applications or in any Search-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Search. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Search or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Search or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Terms, as solely determined by Visit NC, will be disqualified. Visit NC reserves the right at its sole discretion to suspend, modify or terminate the Search at any time and for any reason. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SEARCH MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, VISIT NC RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
