The “A Pirate’s Life For Me” Contest on VisitNC.com (the Contest) begins at 12:00 AM Eastern Standard Time on or about Sept 14, 2009 and ends at 11:59:59 PM Eastern Time on Nov 8, 2009. Employees, officers and directors of the North Carolina Division of Tourism, Film and Sports Development (the Division), participating contest partners, their affiliates, subsidiaries, advertising, promotion, fulfillment and marketing agencies, their immediate families (and those living in their same households) are not eligible to participate in the Contest.
2. ENTRY: Go to www.youtube.com/group/ncpiratecontest (“website”)
and log into your YouTube account or register with YouTube. You must be a member
of the YouTube website and comply with its Terms and Conditions to enter the
contest. Membership is free. Follow the onscreen instructions to enter and
upload your video submission (“Entry”).
Enter as often as you wish; however, each entry must meet the requirements
below (see Item #3) and must be submitted separately. Entries must be received
before the contest ends at 11:59 p.m. ET, 11/8/09. All entrants must have a
valid e-mail address. In case of dispute as to identity of the winner who enters,
entry will be declared/made by the registered user (meeting eligibility criteria)
of the YouTube account, and if a prize is won, it will be awarded to that registered
user. Entries generated by a script, macro or other automated means will be
disqualified.
3. ENTRY REQUIREMENTS: “A Pirate’s Life For Me” Contest
You must abide by these requirements and with YouTube’s Terms and Conditions.
The Division reserves the right to prescreen, monitor and remove postings,
at their discretion.
- Entry must be original, unpublished, the sole property of submitter.
- Entry must be less than two minutes in length and in one of the following formats: .mov, .avi., .wmv or .mpg, not exceeding a file size larger than 100MB.
- Entry must be in English.
- Entry must be compliant with YouTube’s posting requirements and Terms and Conditions, posted at YouTube.
- Entry must not violate third-party rights including, but not limited to: copyrights, including music copyrights, trademark, and right of publicity. Entry must not highlight third-party trademarks, company names or logos.
- Entries must not include unsuitable content or depict or incorporate: unsafe behavior or situations; obscenity; disparagement of any product or person; or other offensive conduct or material, or otherwise include inappropriate content.
- You must have written permission from any identifiable person, who appears in, is heard in, or otherwise contributed to the video Entry (“Participant”). If a Participant is a minor, parent/legal guardian must grant written permission. Participants must pass along all rights for usage to the Division. If entrant is selected as a finalist, they will receive a Participant Release form from the Division via e-mail for Participant signature prior to final judging.
- By submitting an Entry you agree that The Division has the unrestricted right to: use your video Entry in whole or in part, commercially or non-commercially, in any media known or unknown, in perpetuity, worldwide, including the right to publish and display the video Entry for advertising. Additionally you agree that The Division may post your Entry (including your name) on its Web site(s) and/or its web pages on third-party sites. You agree that by submitting this video, you relinquish all rights, as outlined herein, and the Entry, and its content becomes the property of The Division.
4. GRAND PRIZE: GIVEAWAY SELECTION AND NOTIFICATION OF WINNER:
Judging: Judges will select ten (10) finalists from all
eligible entries received on or about 11/9/09. Entries will be judged based
on the following criteria: originality, humor, and creativity. In the event
there are not enough eligible entries received, Sponsor shall, at its sole
discretion, choose a lesser number of finalists than stated in these official
rules.
Finalists: Finalists will be notified via their YouTube account
on or about 11/10/09. Finalists must follow the directions set forth in the
notice, sign a release, and provide a signed release for any other parties
featured in or who otherwise contributed to the video entry, and return all
to The Division (Sponsor) as set forth in the notification by 11/17/09 or finalist
will be disqualified and will forfeit any prize, and another finalist may be
selected. An impartial judge will then judge the finalist’s videos based on
the criteria above and determine the Grand Prize winner.
Prizes: One (1) Grand Prize Winner will receive accommodations,
dining and giveaway items courtesy of the Hyde County Chamber of Commerce at
North Carolina’s coast. Expenses not specifically stated are the sole responsibility
of the winner. Gift Cards are subject to the terms, conditions and restrictions
as printed on the Card. No cash substitutions for prizes will be permitted
and prizes are nonrefundable and nontransferable, except at the sole discretion
of Sponsor. Sponsor reserves the right to substitute prize of equal or greater
value. Federal, state and local taxes are the sole responsibility of the winner
and winner of any prize over $600.00 must provide their information to the
Division (Sponsor), including Social Security number, for tax reporting purposes
or prize will be forfeited and another winner may be selected. Prize will be
awarded to parent or legal guardian if winner is a minor between 18-20 in his
or her state of residency (“Minor”).
Winner: Winner will be notified via email on or about 11/18/09.
Potential Winner will be required to sign, notarize and return the Affidavit
of Eligibility, Release of Liability and W-9 form (IRS) documents within 10
days of receipt or prize will be forfeited in its entirety and another winner
may be selected. After notification, Winners will receive their Prize by mail
within 4-6 weeks of notification. There will be an official announcement to
the public and/or press on or about November 22.
5. DISQUALIFICATION: Contest sponsors are not responsible
for lost, interrupted or unavailable network server or other connections, miscommunications,
failed telephone or computer, telephone transmissions, technical failure, jumbled,
scrambled or misdirected transmissions, or other error of any kind whether
human, mechanical or electronic. Persons found tampering with or abusing any
aspect of this Contest, as solely determined by the judges, will be disqualified.
If disqualified for any of the above abuses contest sponsors reserve the right
to terminate eligibility to participate in the Contest. In the event any portion
of this Contest is compromised by virus, bugs, non-authorized human intervention
or other causes beyond the control of contest sponsors which, in the sole opinion
of the contest sponsors, corrupts, or impairs the administration, security,
fairness or proper play of the Contest, contest sponsors reserve the right
at its sole discretion to suspend or terminate the Contest. Contest sponsors
are not responsible for any problem with the Contest entry generated by computer
hardware or software malfunction, error or failure.
6. TAX INFORMATION: All taxes and fees on prizes won are the sole responsibility of the winner.
